Welcome to Sole Drift PTY LTD ("Company", "we", "our", "us") located at www.soledrift.co.uk. By accessing our website and purchasing a membership, you agree to abide by the following Terms of Service ("Terms"). If you do not agree with these Terms, please do not use our website.

1. No Liability for Site Use and Hidden Locations

1.1. Our website features an interactive map of the United Kingdom with hidden locations, including waterfalls, beaches, wild swim spots, woodlands, viewpoints, coastal coves, and other destinations. The information provided, including GPS coordinates, descriptions, and images, is for informational purposes only.

1.2. We are not responsible for any risks, injuries, damages, legal issues, or losses you may incur by visiting these locations. This includes but is not limited to accidents, wildlife encounters, weather conditions, cold water shock, tides and currents, trespassing violations, property damage, or any other unforeseen circumstances.

1.3. You acknowledge that visiting these locations is entirely at your own risk and discretion. You are solely responsible for ensuring that you have the appropriate permissions, skills, equipment, and safety precautions before accessing any site listed on our platform.

1.4. We do not guarantee access to any location. Some locations may be on private land, have seasonal restrictions, be affected by tides, be unsafe due to natural hazards, or be subject to local byelaws and regulations. It is your responsibility to verify access rights and conditions before visiting any site.

1.5. The number of locations available on the interactive map may fluctuate. While we strive to provide access to hundreds of locations, this number may decrease due to accessibility issues, legal or environmental restrictions, or may increase as new locations are added.

2. Refund Policy

2.1. We offer a 2-hour money-back guarantee on eligible new memberships. To request a refund, contact admin@soledrift.com within 2 hours of purchase.

2.2. Refunds will not be granted where we reasonably determine that the member has engaged in excessive access, bulk export, scraping, systematic copying, sharing of login credentials, or other conduct intended to replicate the map content.

2.3. If a refund is denied under clause 2.2, we will provide written notice explaining the basis for refusal and any account action taken.

2.4. We reserve the right to suspend or terminate access prior to resolution where we reasonably suspect infringement, fraud, or automated scraping.

3. Membership Types & Access

3.1. We offer three membership types:

  • Monthly (recurring every 30 days)

  • Yearly (recurring every 12 months and includes one friend invite for 1-year access)

  • Lifetime (a one-time payment for access for the lifetime of the website)

3.2. "Lifetime access" refers to the lifetime of the website and its services, not the lifetime of the customer. We reserve the right to modify, limit, or discontinue the website or its services at any time.

3.3. Monthly and yearly memberships are recurring and will be automatically renewed unless cancelled prior to the renewal date. You can manage or cancel your subscription through your customer account.

3.4. Failure to complete a payment due to insufficient funds or expired payment methods may result in immediate suspension of access until payment is resolved.

3.5. Sole Drift reserves the right to offer promotional access, trials, or additional benefits at its discretion to new or existing members.

3.6. We may suspend or revoke access for breach of these Terms. Refunds for breaches are at Sole Drift’s sole discretion.

4. Content Accuracy and Availability

4.1. While we strive to provide accurate and up-to-date information, we do not guarantee the completeness, reliability, or accuracy of any content on our website.

4.2. We may update, modify, or remove information at any time without notice. Users are responsible for verifying location details, access rights, local regulations, and ensuring their safety when visiting any recommended sites.

4.3. We may modify coordinates, descriptions, or remove locations to protect the environment or comply with law.

5. Indemnification

By using our website, you agree to indemnify and hold us harmless from any claims, damages, or liabilities arising from your use of the information provided, including but not limited to:

  • Personal injuries, accidents, illnesses, or fatalities

  • Legal disputes regarding land access, public rights of way, trespassing, or permits

  • Environmental damage or violations of local regulations or byelaws

6. No Warranties & Limitation of Liability

6.1. We make no warranties, expressed or implied, regarding the usability, safety, legality, or accessibility of any location listed on our website.

6.2. Under no circumstances shall we be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of our website, even if we have been advised of the possibility of such damages.

7. Prohibited Uses

7.1. You agree not to use our website or content for any unlawful or unauthorised purpose. Prohibited activities include (but are not limited to):

  • Scraping, crawling, harvesting, downloading, bulk export, systematic copying, or other automated extraction of content or coordinates

  • Reproducing, republishing, uploading, distributing, transmitting, selling, sublicensing, publishing, or commercialising any content, coordinates, images, or descriptions from the Site without our prior written permission

  • Sharing login credentials or otherwise enabling access by third parties who are not authorised members

  • Removing or altering any copyright, trademark, or other proprietary notices

  • Reverse engineering, decompiling, disassembling, or attempting to derive any underlying data structures, algorithms, or proprietary markings

7.2. Any attempt to circumvent our technical measures or to remove, alter, or obfuscate proprietary identifiers embedded in our content is strictly prohibited.

7.3. Sole Drift actively monitors for unauthorised or unusual access. Accounts exhibiting behaviours consistent with scraping, automated exports, credential sharing, or large, rapid volume access may be automatically suspended pending investigation.

8. Proprietary Coordinates & Forensic Markers

8.1. Sole Drift’s coordinates, metadata, and other location identifiers are proprietary. We employ confidential forensic markers and technical protections to help detect unauthorised copying or redistribution of our content.

8.2. The presence of Sole Drift’s proprietary markers or an exact match to our proprietary coordinate fingerprints in a third-party dataset or product is prima facie evidence of unauthorised use of our content and may be used as the basis for enforcement, including suspension of access, takedown notices, injunctive relief, and monetary claims.

8.3. You must not disclose, attempt to circumvent, alter, or publicise the existence, nature, placement, or method of our forensic markers. Any such attempt is a material breach of these Terms and may result in immediate termination and damages.

9. Monitoring, Evidence Preservation & Audit Rights

9.1. By using the Site you acknowledge and consent that Sole Drift may monitor usage patterns, collect logs, and retain records for the purpose of detecting unauthorised access and enforcing these Terms.

9.2. Sole Drift may preserve and use access logs, forensic analysis, and other electronic records as evidence in any investigation, enforcement action, or legal proceeding.

9.3. We reserve the right to perform audits (including forensic review) of any account we reasonably suspect of misuse. You consent to cooperate with reasonable audits and investigations.

10. Enforcement, Remedies & Injunctive Relief

10.1. If we believe you have breached these Terms, we may, in our sole discretion, do any or all of the following:

  • Suspend or terminate your account and access

  • Require you to return or destroy all copies of the content in your possession

  • Seek injunctive relief and other equitable remedies to prevent further unauthorised use

  • Seek monetary damages, including statutory or actual damages and recovery of legal fees and costs

  • Report any unlawful conduct to relevant authorities

10.2. You acknowledge that breach of Sections 7, 8 and 9 may cause irreparable harm to Sole Drift for which monetary damages alone would be inadequate; Sole Drift is therefore entitled to seek injunctive relief.

11. DMCA, Takedowns & Third-Party Platforms

11.1. If you discover Sole Drift content on a third-party site without authorisation, please notify us at admin@soledrift.com with full details. We may pursue takedown notices or other measures.

11.2. If you are a rights owner who believes that your content has been posted in violation of the law, follow the contact procedures above.

12. Copyright and Intellectual Property

12.1. All content displayed on the Sole Drift platform, including coordinates, descriptions, curated locations, photographs, UI, and design elements, are the intellectual property of Sole Drift PTY LTD or its licensors.

12.2. No part of this content may be reproduced, distributed, or transmitted in any form without our prior written permission.

12.3. Any unauthorised reproduction, publication, or distribution is a material breach of these Terms and may result in civil and criminal penalties.

13. Anti-Circumvention & Reverse Engineering

13.1. You must not attempt to circumvent, disable, or interfere with any technical protection used on the Site, nor attempt to reverse engineer or reconstruct the map data in whole or in part.

13.2. Attempts to slightly alter coordinates in order to obfuscate copying, or to create derivative lists that use our proprietary markers, are prohibited.

14. Account Termination, Suspensions & Fees

14.1. Sole Drift may terminate or suspend accounts for breach or suspected breach. Termination does not waive rights to pursue damages or other remedies.

14.2. We reserve the right to recover any costs reasonably incurred in investigating or remedying the breach, including legal fees.

15. Confidentiality of Proprietary Markers

15.1. The existence, design, placement, and method of Sole Drift’s proprietary markers and forensic measures are confidential and proprietary information. You agree not to disclose any such information under any circumstances.

16. Changes to Terms

We reserve the right to update, modify, or replace these Terms at any time. Continued use of our website after changes are posted constitutes acceptance of the revised Terms. Members will be notified of material changes to these Terms where legally required.

17. Pricing and Subscription Changes

17.1. We reserve the right to change our membership pricing at any time. Price changes will apply to new subscribers or at the time of renewal for existing monthly or yearly members.

17.2. Existing Lifetime members will not be affected by future pricing changes.

17.3. Special promotions, discounts, or offers are subject to change and may be limited in availability or duration.

17.4. If your subscription is cancelled or payment fails, you may lose access to promotional perks or historical pricing.

18. Charitable Donations

18.1. We are committed to donating 5% of our business profits to charities that support environmental conservation and the preservation of natural areas in the regions in which we operate.

18.2. Donations are calculated based on net business profits at the end of each financial year and are distributed to one or more organisations of our choosing.

18.3. While we strive to fulfil this commitment, we reserve the right to modify, pause, or discontinue donations at our discretion due to unforeseen business or financial circumstances.

19. Governing Law & Dispute Resolution

19.1. These Terms are governed by and construed in accordance with the laws of England and Wales.

19.2. Any disputes arising out of or related to these Terms, the Services, or your use of the Site shall be subject to the exclusive jurisdiction of the courts of England and Wales.

19.3. If you are a consumer resident in the UK or EU, you may also benefit from any mandatory provisions of the law of your country of residence. Nothing in these Terms affects those rights.

20. Survival

Provisions concerning ownership, restrictions, indemnities, monitoring, enforcement (including Sections 2, 7, 8, 9, 10, 12, 13 and 15) survive termination.

21. Entire Agreement & Severability

These Terms constitute the entire agreement between Sole Drift and its users. If any provision is unenforceable, the remainder remains in force.
